Check the Pepper Spray Laws in Your Area. Pepper spray laws can be different in different areas. Some states regulate or forbid tear gas, or some may allow cities to make their own assorted laws regarding tear gas. Many countries, including Canada, also forbid tear gas. For this reason, it́s a good idea to call the law enforcement agency that has jurisdiction over your destination before you bring pepper spray there. Pepper Spray is legal in all 50 states. However, possession and/or use may be regulated or prohibited by law in some jurisdictions. States That it is Illegal to Buy Pepper Spray by Mail or Through the Internet:

Hawaii, Indiana, Massachusetts, Michigan, New Jersey, New York, Pennsylvania, Rhode Island, and Wisconsin.

Wisconson Pepper Spray Law:

Tear gas is not permissible. By regulation, OC products with a maximum OC concentration of 10% and weight range of oleoresin of capsicum and inert ingredients of 15-60 grams are authorized. This is 1/2 oz. and 2 oz. sprays. Further, the product cannot be camouflaged, and must have a safety feature designed to prevent accidental discharge. The units may not have an effective range of over 20 feet and must have an effective range of six feet. In addition there are certain labeling and packaging requirements: must state cannot sell to anyone under 18 and the phone number of the manufacturer has to be on the label. The units must also be sold in sealed tamper-proof packages.  Can be no stronger then a 2% concentrate. CS is the only Tear Gas accepted and can be no larger then 35 grams per can. No combination spray allowed.   Animal repellents are permitted

Pepper spray law in Massachusetts:

Residents may only purchase defense pepper sprays from licensed Firearms Dealers in that state. You must have Firearms Identification card ( FID ).

Using Pepper Spray in California:

Misuse of tear gas in California comes with state penalties of up to a $1000 fine and/or up to three years in prison, not to mention a possible felony conviction on record. Examples of misuse include using tear gas on people in anger, spraying it as a joke, or possession of tear gas by prohibited persons. Minors, drug addicts or persons convicted of felonies, assault or misuse of tear gas are legally prohibited from possessing tear gas, although there are few barriers to procurement of tear gas by these people. To be legally purchased, possessed or used in California, any canister must have a label that says "WARNING: The use of this substance or device for any purpose other than self-defense is a crime under the law. The contents are dangerous--use with care." The maximum legal net weight for a canister is 2.5 ounces, or 70 grams of OC.

Using Pepper Spray in New York:

New York residents may only purchase defense sprays from licensed Firearms Dealers or licensed Pharmacists in that state. Animal repellents are permitted. 

 

Michigan Pepper Spray Law: 

OC Pepper spray can be no stronger then a 2% concentrate (Different companies can sell different concentrations.) CS is the only Tear Gas accepted and can be no larger then 35 grams per can. No combination spray allowed.    Click here to view Michigan approved products.

  • Canada – Pepper spray is classified as a prohibited weapon. A number of dog and significantly stronger bear pepper sprays are legal to own. However, use of these items against humans will most likely result in the user being prosecuted.  Click here to view these products
  • Can I carry my pepper spray anywhere?

    No, there are places that restrict and/or forbid pepper sprays. For instance they are restricted from being carried on board any commercial aircraft. Carrying pepper spray on to a commercial airliner is a Federal crime that carries high fines, and possible imprisonment.

    Although, it is generally permitted to carry pepper spray in your checked baggage, I highly recommend you notify the ticketing agent when you check your baggage.

    So, if want to bring your
    Hot Walker Pepper Sprays to carry on a run during your business trip or vacation, make sure you let the airline know they are in your luggage.

    Pepper sprays cannot be put on a cargo plane due to the compression of the spray. As a result pepper sprays are only shipped via Ground within the continental United States. If you live in Hawaii it may be cheaper to purchase from a local supplier or retail location.

    Since the tragedy of 9/11 you may also have issues when carrying pepper spray into secured locations such as Federal and State buildings, or any where you must pass through a security checkpoint.

    Make sure if you wear a
    self defense pepper spray ring that you remove it prior to entering a Federal or State building.

    I am not aware of any pepper spray laws that have specifically outlined other secured buildings, but you should use common sense before carrying your defense spray into any secure location.

    NOTE: Pepper Spray is legal in all 50 states, however a number of cities and states have restrictions on sizes, strengths, etc.. If you have a question, it is wise to check with you local city or state attorneys office. Defense sprays should only be purchased by those 18 years of age or older.
